Welcome to Sundays at Margaret's (sundaysatmargarets.com). These Terms of Service ("Terms") apply to your use of our website and to every purchase of our cookbooks, in digital form and, where offered, as printed books. By using our website or placing an order, you agree to these Terms.

The following policies form part of these Terms: our Refund Policy, Shipping & Delivery Policy, Privacy Policy and Payment Policy. If a specific policy and these Terms differ on a topic, the specific policy applies to that topic.

Your statutory rights always come first. Nothing in these Terms removes or limits any right you have under consumer protection laws that cannot be excluded or limited by contract in the country, state or province where you live. Section 22 explains the most important of these rights.

1. Who we are

Sundays at Margaret's is a brand operated by Moneza LLC, a limited liability company organized in Wyoming, United States ("we", "us", "our"). Our business address is 1501 South Greeley Hwy, Ste C, Cheyenne, WY 82007, United States. You can reach us at margaret@sundaysatmargarets.com. Our online store is hosted on Shopify.

2. About Margaret

Margaret Clark is the friendly face and voice of Sundays at Margaret's. She is a fictional brand character created by our team. Images and videos of Margaret, and many of the food photographs on our website, in our books and on our social media, are created or enhanced with digital tools, including artificial intelligence. They are shown for illustration and inspiration; your finished dishes may look different.

Our recipes are developed by our team, with the help of digital tools including artificial intelligence, and reviewed by us before publication. Margaret's stories are part of our brand storytelling and are not personal testimonials or endorsements.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By using our website you confirm that the information you give us is accurate, current and complete. Our website is not directed at children under 13.

4. Where we sell

We welcome customers from around the world. Our marketing is focused on the United States, Canada, the United Kingdom, Australia and New Zealand, but you can order from almost any country. Digital cookbooks are delivered by email worldwide. Printed books can only be shipped to the countries available at checkout. We may decline orders from a country where we cannot lawfully sell, for example because of sanctions; if we cancel after payment, we refund you in full.

5. Our products

We sell digital cookbooks in PDF format. They are delivered electronically by email and download link. Unless you choose a printed edition, no physical book is shipped. Some cookbooks include free access to an online "web edition" of the book on our website, as a bonus.

Printed editions. We may also offer some cookbooks as printed hardcover books. A printed book is only part of your order if you choose a printed edition, or a bundle that includes one, and it is listed in your order confirmation. Printed books are printed to order; small differences in color, paper and binding compared with photos on our website are normal.

  • Images are illustrations. On digital products, pictures showing a book as a hardcover, paperback or printed copy are mockups made to show what the cover looks like.
  • What you need for digital books: a phone, tablet or computer that can open PDF files (most devices can, for example with Apple Books, Google Drive or the free Adobe Acrobat Reader), an email address and an internet connection for the download and the web edition.
  • Measurements: recipes use US and metric measurements.
  • Changes: we may update product descriptions, prices and availability at any time. Changes never affect an order we have already confirmed.

We work hard to describe our books accurately. If a product does not match its description, our Refund Policy explains how we will put it right.

6. Health, nutrition and allergen disclaimer

Our books, recipes, web editions, emails and social media posts are for general information and cooking inspiration only. They are not medical, nutritional or dietary advice, and they are not written by doctors or dietitians. Nothing we publish is intended to diagnose, treat, cure or prevent any disease or condition.

  • "Healthier" means our cooking approach. Words such as "healthy", "healthier", "lighter" or "high-protein" describe our general approach to ingredients compared with traditional versions of similar dishes, for example less refined sugar or more whole foods. They are not health claims and do not mean a recipe suits any particular medical condition or diet.
  • Nutrition figures are estimates. Any nutritional information (such as calories or protein per serving) is estimated from standard ingredient data. Actual values depend on the brands, quantities and methods you use. Do not rely on them to manage a medical condition.
  • Talk to your doctor first. Always consult your doctor or a qualified health professional before changing your diet, especially if you have diabetes, heart, kidney or digestive conditions, food allergies, take medication, or are pregnant or breastfeeding.
  • Allergens. Recipes may contain or come into contact with common allergens, including nuts, peanuts, dairy, eggs, wheat and gluten, soy, sesame, fish and shellfish. Labels such as "gluten-free", "dairy-free" or "vegan" refer to the ingredients as written in the recipe. Ingredient products differ, so always check the packaging of every ingredient you buy against your own allergies, intolerances and dietary needs.
  • Food and kitchen safety. Follow safe food-handling practices, cook food to safe internal temperatures, and take care with ovens, hot liquids and sharp tools. Ovens, cooking times and ingredients vary, so results can differ from what is described.

You are responsible for deciding whether a recipe is suitable for you and the people you cook for.

7. Orders and when a contract is formed

Product pages on our website are an invitation to buy, not a binding offer. When you place an order, you make an offer to buy. A contract between you and us is formed when we send your order confirmation email. That email is your proof of purchase and contains a summary of your order.

We may decline or cancel an order where reasonably necessary, for example if we suspect fraud or unauthorized use of a payment method, if there is a clear pricing or technical error, or if an order appears intended for resale or redistribution of our books. If we cancel an order after you have paid, we refund the full amount to your original payment method.

Please make sure the email address and, for printed books, the shipping address you enter at checkout are correct.

8. Prices, taxes and payment

Prices are set in US dollars. Where available, prices are shown and charged in your local currency (for example CAD, GBP, EUR, AUD or NZD), converted at the current exchange rate. Depending on where you live, we may be required to charge sales tax, VAT, GST or HST. Where the law of your country requires prices to be displayed including tax, we display them that way. In every case, the full total, including any tax and any shipping costs for printed books, is shown at checkout before you pay. We do not add hidden fees.

Payment is taken in full when you place your order. Payment methods and billing details are set out in our Payment Policy. By submitting payment details, you confirm that you are authorized to use that payment method.

Pricing errors. If a product is listed at a clearly incorrect price because of a typing or technical error, we will contact you before delivering your order. You can then choose to confirm the order at the correct price or cancel it for a full refund. We will never charge you more than the price you agreed to without your explicit consent.

Discount codes and promotions. Unless stated otherwise, only one discount code can be used per order. Discount codes have no cash value, cannot be applied to past orders and may end at any time. Each promotion may have its own terms, which are shown with the promotion.

9. Delivery, and immediate supply of digital content

Digital cookbooks are delivered by email, usually within minutes of payment confirmation. Printed books are printed to order and shipped to you. Full details are in our Shipping & Delivery Policy.

Because our products are digital content, by completing your order you expressly request that we supply your digital content immediately, and you acknowledge that once supply has begun, you lose any statutory right to cancel the contract during a cooling-off period, where such a right exists (for example the 14-day cancellation right in the United Kingdom and the European Union). We confirm this in your order confirmation email.

Printed books. Ownership of a printed book, and the risk of loss or damage, pass to you when the book is delivered to you. The acknowledgment above applies only to digital content: printed books can be returned as described in our Refund Policy.

10. Refunds

Refunds are handled under our Refund Policy. In short: we do not offer change-of-mind refunds once your digital cookbook has been delivered, printed books can be returned within 30 days of delivery, and if a book is faulty, damaged, not as described or never delivered, or you were charged twice, we will fix it, replace it or refund you. Your statutory rights are not affected.

11. Your license to use our books

When you buy a digital cookbook, you receive a personal, non-exclusive, non-transferable license to use it for your own personal, non-commercial use within your household. You do not buy the copyright in the book.

Printed books. When you buy a printed book, you own that physical copy and may keep it, give it away or resell it. The copyright in its content stays with us: you may not copy, scan or reproduce its pages, except for personal use in your own kitchen. The rest of this section applies to digital books.

You may:

  • download the PDF and keep copies on devices you own or use personally;
  • print pages for use in your own kitchen;
  • cook the recipes for yourself, your family and friends, and share the food you make.

You may not:

  • share, forward, email, upload, post, resell, rent, lend, give away or otherwise distribute the PDF, the download link, the web edition link or QR code, or any part of the content, in any form;
  • copy, republish or sell our recipes, text, photographs or designs, including on websites, social media, apps, printed materials or in other books;
  • use our content in any commercial product or service, or offer it with private label or resale rights;
  • upload or feed our content into artificial intelligence tools or datasets to create, train or generate other content;
  • remove or change copyright notices, or try to get around any access controls.

Web edition. Online web editions are a free bonus for personal use by the buyer. We intend to keep them available, but we may update, change or discontinue a web edition, for example for technical reasons. Where practical, we will give reasonable notice. Your PDF remains your permanent copy.

Corrections. If we publish a corrected or improved version of a book you bought, we may send it to you free of charge.

Breach of license. If you break this section, your license ends automatically and we may disable your access to web editions and downloads. We may also take any other action available to us under the law.

12. Customer accounts

If you create an account, keep your login details private and let us know straight away if you think someone else has used your account. You are responsible for activity under your account that results from you not keeping your login details safe.

13. Intellectual property

All content on our website, in our books and on our social media, including text, recipes as written, photographs, images, videos, designs, layouts, the Sundays at Margaret's name and logo and the Margaret Clark character, is owned by Moneza LLC or its licensors and is protected by copyright, trademark and other intellectual property laws. Except as permitted in Section 11, you may not copy, reproduce, scrape, modify, distribute or create derivative works from our content without our prior written permission.

If you believe that content on our website infringes your copyright, email us at margaret@sundaysatmargarets.com with your contact details, a description of the work, where it appears on our website, and a statement that you believe in good faith the use is not authorized. We will review every notice promptly.

14. Reviews and content you send us

We welcome honest reviews, good and bad. Nothing in these Terms restricts your right to publish an honest review of our products. We publish genuine reviews without changing their meaning. We may decline or remove a review only if it is unlawful, offensive, spam, unrelated to the product, contains someone's personal information, or appears not to come from a genuine customer.

If you send us reviews, photos of your dishes, comments or ideas, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display them in connection with our store and its promotion. Where we feature your name or photo in an advertisement, we will ask for your permission first. You confirm that you have the right to share what you send us.

15. Acceptable use

You agree not to use our website or products:

  • for any unlawful, fraudulent or misleading purpose;
  • to infringe our intellectual property or anyone else's rights;
  • to interfere with the security or operation of the website, or to introduce viruses or harmful code;
  • to scrape, copy or systematically extract content or data, including by bots or automated tools;
  • to collect personal information about other people;
  • to place fraudulent orders or make false refund requests or payment disputes.

We may restrict or end your access to the website if you break this section.

16. Payment disputes and chargebacks

If something is wrong with a payment or an order, please email us first. We can usually solve it within one or two business days, which is much faster than a dispute through your bank. If you open a dispute or chargeback, we may share relevant information with the payment provider and your card issuer, such as your order details, delivery confirmation, download and access records, and these Terms. If a chargeback is filed for an order that was delivered as described, your license under Section 11 ends and we may disable access to the related downloads and web editions. This does not affect your right to dispute a charge you did not authorize.

Our website uses third-party services, such as Shopify and our payment providers, and may link to other websites and social media. We are not responsible for the content, policies or practices of third parties. Your use of their services is subject to their own terms.

18. Disclaimer

To the extent permitted by law, our website and its content are provided "as is" and "as available". We cannot promise that the website will always be available, uninterrupted or error-free, or that any recipe will produce a particular result. This section does not affect our responsibility to provide digital content that matches its description and is of satisfactory quality, or any other right you have under applicable consumer law.

19. Limitation of liability

To the maximum extent permitted by law:

  • our total liability to you arising from or relating to an order is limited to the amount you paid for the product concerned; and
  • we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue or data, that was not reasonably foreseeable when the contract was made.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any other liability that cannot be limited or excluded by law. If our digital content damages a device or other digital content belonging to you because we did not use reasonable care and skill, we will repair the damage or pay you compensation where the law requires us to.

20. Indemnity

To the extent permitted by law, you agree to reimburse us for reasonable losses and costs we suffer as a direct result of your unauthorized copying or distribution of our content or your breach of Section 11 or Section 15. This does not apply to the extent the loss was caused by our own breach or unlawful conduct.

21. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as internet or email outages, carrier or postal disruptions, printing-facility outages, failures of our platform or payment providers, natural disasters or government action. If this prevents us from delivering your order within a reasonable time, we will tell you and offer a full refund.

22. Your rights as a consumer, by country

United States. Some states do not allow certain disclaimers, exclusions or limitations of liability, so some of the limits in these Terms may not apply to you. You may also have other rights under the laws of your state.

United Kingdom. Under the Consumer Rights Act 2015, digital content and goods must be of satisfactory quality, fit for purpose and as described. If it is not, you are entitled to a repair or replacement, or, if that is not possible or not done within a reasonable time, a price reduction, which may be a full refund. Under the Consumer Contracts Regulations 2013 you normally have 14 days to cancel a contract for digital content, but this right ends once supply has started with your express request and acknowledgment (see Section 9). For printed books, you can reject faulty goods for a full refund within 30 days, and you can cancel within 14 days after delivery (our Refund Policy gives you 30 days). Free and impartial advice is available from Citizens Advice.

Australia. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law.

New Zealand. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply.

Canada. Nothing in these Terms limits rights you have under the consumer protection laws of your province or territory. If you live in Quebec, any provision of these Terms that is not permitted under the Quebec Consumer Protection Act, including provisions about the limitation of our liability, does not apply to you.

European Union. You have the rights given by EU consumer law, including the right to digital content and goods that conform to the contract, with a legal guarantee of at least two years for printed books. You also have a 14-day right of withdrawal. For digital content, it ends once supply has started with your express consent and acknowledgment (see Section 9). For printed books, it runs from delivery (our Refund Policy gives you 30 days).

All other countries. Nothing in these Terms limits mandatory consumer rights you have under the law of the country where you live.

23. Governing law and resolving problems

If something is not right, please email us first at margaret@sundaysatmargarets.com. We read every message personally and will try to find a fair solution. To give us that chance, please allow us 30 days to resolve a complaint before starting formal proceedings, unless the law where you live does not allow this requirement.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Subject to the next paragraph, the state and federal courts located in Wyoming have jurisdiction over any dispute.

If you are a consumer living outside Wyoming, you keep the protection of the mandatory consumer laws of the place where you live, and you may bring a claim in the courts of your home country, state or province where the law allows you to.

24. Changes to these Terms

We may update these Terms from time to time. The updated version takes effect when we publish it on this page, with the new "Last updated" date. The version in effect when you placed your order applies to that order.

25. General

  • Severability. If any part of these Terms is found invalid or unenforceable, the rest remains in full force.
  • No waiver. If we do not enforce a provision straight away, we can still enforce it later.
  • Transfer. We may transfer our rights and obligations under these Terms to another business, for example if our business is sold, without reducing your rights. You may not transfer your rights under these Terms.
  • Entire agreement. These Terms and the policies they refer to are the entire agreement between you and us about your use of the website and your purchases.
  • Electronic communications. You agree to receive contracts, confirmations and notices from us electronically, including by email and on our website.
  • Language. These Terms are written in English. If we provide a translation, the English version applies in case of any difference, unless the law where you live requires otherwise.
